PAETEC Disconnects MonsterHut For Spamming - May 06, 2002
Fairport, NY, May 6, 2002/Businesswire/- PAETEC Corp., a holding company whose principal subsidiary is PAETEC Communications, Inc., an integrated communications provider, announced that it had terminated Internet access service to MonsterHut, Inc., a direct e-mail marketing company, for sending unsolicited, mass, commercial e-mail ("spam") in violation of PAETEC's Acceptable Use Policy ("AUP") and service contract.

PAETEC's action immediately followed a favorable appellate court ruling in a lawsuit originally filed by MonsterHut back in March 2001. The May 3, 2002, ruling by the New York Supreme Court, Appellate Division, reversed the trial court and vacated an injunction that had been in effect for over thirteen months, barring PAETEC from terminating service to MonsterHut. The appellate court also granted summary judgment for PAETEC, declaring that PAETEC had established as a matter of law that its service agreement with MonsterHut prohibited spamming, that MonsterHut had violated the agreement by engaging in spamming, and that PAETEC "may terminate the agreement in response to [MonsterHut's] sending of unsolicited, mass, commercial e-mail in breach of the agreement." Within an hour after the decision was released, PAETEC disconnected MonsterHut's Internet access service.

"PAETEC has always strived to be a responsible member of the Internet community," said Sanjay Hiranandani, PAETEC's vice president of data engineering. "PAETEC's policy is, and always has been, that spamming is not an appropriate use of the Internet and will not be tolerated."

Slaughter Opposes House Bill To Shut Out Competition For High Speed Internet - Feb 26, 2002
Rochester, NY - Congresswoman Louise M. Slaughter today announced her opposition to H.R. 1542, the so-called Tauzin-Dingell broadband bill. The legislation, to be voted on by the House of Representatives this week, would change the manner in which high-speed Internet service delivered over phone lines is governed. The change would lock out competition for data service on local phone networks for companies that seek to compete with the Regional Bell Operating Companies (Bells). Rep. Slaughter announced her opposition to the bill in comments to employees of the PAETEC corporation in Fairport.

"Competition creates jobs, lowers prices, and promotes better service. It is just that simple," said Rep. Slaughter. "If this bill passes, we will concentrate the delivery of high speed Internet into the hands of a few, and business and consumers will pay the price." The Tauzin-Dingell bill would make a fundamental change in the Telecommunications Act of 1996. Until the passage of the '96 act, local phone companies had a monopoly on both voice and data transmission over telephone lines. Many of the local networks, often called local loops, were built with taxpayer and ratepayer dollars during the deployment of phone service to every customer in the United States. Under current law, local phone companies, like Verizon, must make their networks available to other companies that want to offer traditional phone service and high speed Internet service. The Act provided that local bell monopolies could enter the profitable long distance market if they could prove to the Federal Communications Commission that they had sufficiently opened up their local networks for competition. The bill that Slaughter is opposing today would change the legal definition of traditional telephone service and Internet traffic. Tauzin-Dingell will no longer require Bell companies to make available local phone networks for high speed Internet service, potentially eliminating competition between local companies like PAETEC, Choice One and the regional Bells. Slaughter noted that the Tauzin-Dingell bill would restrict competition for high speed Internet service, but will not change the ability of the local Bell monopolies to enter the long distance market.

"This is special interest legislation at its worst. We need to create jobs in this country, but passing this bill will only force the Bell competitors out of business," Slaughter continued.
